What does it mean when a Patent is “Patent Pending”?

The use of the term “patent pending” means that you have filed either a provisional or non-provisional patent application with the United States Patent Office, and that patent application is not granted and  has not been abandoned.  If an inventor has patent pending status for an invention and an infringer begins to use that invention without the inventor’s permission, the inventor can proceed to get the patent issued and sue the company for patent infringement.

Patent pending is a warning that if a patent issues, then someone may be infringing on a patent retroactively.
